WAN HAI AND FMC REACH CIVIL PENALTY AGREEMENT REGARDING D&D FEES

After two prior efforts were turned down last year, Wan Hai Lines' settlement agreement with the U.S. Federal Maritime Commission regarding its detention and demurrage policies has been approved by an administrative law judge. The carrier has now agreed to pay $950,000 in civil fines and charge refunds as part of the FMC's most recent campaign to outlaw D&D fees.
The case concerns detention charges that Wan Hai applied at least 21 times in the spring of 2021 and goes back to December of that year. The FMC stated the charges invoiced ranged from $125 to $1,550 per container in the initial filing on December 30, 2021.
